§ 11.08.010. Selling from vehicle—Restricted.

  • A.

    Except as otherwise provided herein, it is unlawful for any person or persons to place any vehicle wholly or partly within any county street or highway traffic lanes for the purpose of selling therefrom or therein any article, service or thing.

    B.

    A person will not be in violation of this section if the vehicle is lawfully parked wholly outside of any traffic lane on any county street or highway where the speed limit is greater than or equal to twenty-five miles per hour.

    C.

    A person will not be in violation of this section if the vehicle is lawfully parked in a manner that does not restrict the flow of traffic on any county street or highway where the speed limit is less than twenty-five miles per hour.

    D.

    No person selling from a vehicle in compliance with subdivision (B) or (C) of this section shall conduct their business in a manner where customers are permitted access to the person selling from the vehicle and/or permitted to conduct transactions with the person selling from the vehicle, from the side of the vehicle facing the county street or highway, or in a manner where individuals are induced to enter into and remain within a county street or highway as a result of intending to conduct a transaction with the person selling from the vehicle.

    E.

    The provisions of this section shall not prohibit a seller from taking orders or delivering any commodity from within a vehicle on that part of any county street or highway immediately adjacent to the premises of the purchaser.

    F.

    It is unlawful for any person or persons to place any vehicle or wholly or partly within any county street or highway, for the purpose of selling the vehicle, where the speed limit is greater than or equal to twenty-five miles per hour.

    G.

    It is unlawful for any person or persons to place any vehicle or wholly or partly within any county street or highway, for the purpose of selling the vehicle, for more than twenty-four hours where the speed limit is less than twenty-five miles per hour.

    H.

    It is unlawful for any person or persons to place any disabled vehicle or wholly or partly within any county street or highway traffic lane. It is unlawful for any person or persons to place any disabled vehicle or wholly or partly within any county street or highway, but outside of a traffic lane, for more than forty-eight hours.

    I.

    It is unlawful for any person or persons to place any structure wholly or partly within any county street or highway for the purpose of selling the same or of selling therefrom or therein any article, service, or thing.

    J.

    Exceptions to this section may be made by the county through the issuance of an otherwise valid use or special permit.
